TOPIC DETAIL

This important presentation will focus on two critical components: 

(1) Proper treatment of 2022 calendar plan year items, including:

  • Execution of required amendments,
  • Correction of 2021 ADP and ACP violations that were not corrected earlier in 2022,
  • Timely distribution of various 401(k) plan notices for the 2023 plan year,
  • The proper calculation of 2022 required minimum distributions, and
  • Forfeitures.

(2) Recommended actions for the 2023 calendar plan year, including:

  • Updating SPDS,
  • Advising participants regarding their designation of beneficiary forms,
  • Reviewing and updating - if necessary - a plan’s investment policy statement,
  • A plan administrator’s responsibility for obtaining the proper certification for an ERISA Section 103(a)(3)(C) audit,
  • The new DOL guidance on independent qualified plan accountants,
  • Automatic cash-outs,
  • ERISA’s bonding requirements,
  • Best practices with respect to avoiding missing participant issues, and
  • The DOL’s guidance on cybersecurity and the response of plan sponsors and service providers with respect to this guidance.
