Correcting the Top 10 Distribution Failures

Navigating the maze of distribution and taxation rules for retirement plans has always been one of the more difficult challenges of retirement plan administration. Congress and the IRS continue to add rules that overlap and, at times, seem to contradict existing rules.

Unfortunately, the numerous and overlapping rules lead to distribution errors that need to be corrected to avoid costly penalties and plan disqualification.

In this session, we will discuss the corrections of the following distribution failures:

  •         Overpayment in a defined contribution plan
  •          Failure to calculate and make the RMD timely
  •          Failure to obtain spousal consent
  •          Improper hardship distribution
  •          Failure to report loan deemed distribution and offset
  •          Improper QDRO distribution
  •          Violation of 401(k) distribution restrictions
  •          Death RMD failure
  •          Distribution and consent notice failures
  •         Overpayment in a defined benefit plan

Eligibility Choices: Benefits and Consequences

One of the more important plan design considerations is the eligibility provision. The choice of an eligibility provision can significantly affect the plan cost and administration.

In selecting the appropriate eligibility provision, the practitioner needs to carefully weigh and explain the benefits and burdens. Your eligibility choice also will affect other issues, such as rehired employees, part-time employees and seasonal employees.

In this session, we will discuss the various eligibility choices so that you are better prepared to help your clients make the most appropriate choice.
